Well we all know how fiercely Alembic takes and defends it's brand and people wrongly attributing things to their name so I would think if Alembic thought there were copyright infringements with this Clarke Leiber  instrument they would be right on their tail. Copyright law is a complex animal.
 
In the market these two companies are in it's a niche area with low volumes and high cost where they both need to survive, so morally you would think they would take another path in developing a new instrument to avoid contention and show original design concepts.
 
Look how many Fender strat & bass clones out there even though fender are massive and could in most probability afford to sue them all.  
 
I think Alembic and Clarke have such a close bond that it's unlikely to result in lawsuits  and Stanley Clarke still uses alembics as his main instrument. However I'd love to know what the Wickershams think.

It appears that Stanley wanted his custom basses access to his Alembic DS-5R configuration leading to his rig.

#12, you got that right. I totally agree with you. Stanley always sell his Spellbinder basses. I believe that bass he's holding, is available for 15K.
 
I wish him and Thomas the very best never the less. I have great respect for Thomas Lieber, he's a cool cat to know.
