Well, they didn't ask me if they could use my image OR the image I licensed from Alan Briot for the background.

I had a similar situation last year. One of my former band members whom I toured with in the mid 2000's, wanted some promo photos for an album he was planning so one morning during a european tour we were in the beautiful city fo Salamancar Spain we got up early and went out around the main town square, where we had gigged the previous night  and I took loads of photos of him with his saxophone.  Moving on to last year, he sadly passed away and I attended his wake with many of our mutual friends. After the speeches I looked over at the table where there was a couple selling memorabilia and lo and behold, they were selling T-shirts with my photo of him on for £10 each. I asked them who took the photo and they didn't know,  and told me they got it off facebook. After picking up one of their business cards, I told them that it was actually me who took the photo and explained where and when it was and they were in breach of copyright but if the proceeds went to my friend's children I would not take it further. Fortunately the quality was rubbish and I never saw any sold so even if they were planning to make a killing, that never happened. After that I removed the rest of the photos from FB and put a water mark across the middle when publishing others  as previously it was at the bottom and they had trimmed it off the image.
