I just e-mailed the person who bought the Bass POD in September from the same seller using the same pix.  I'll advise of his response if I receive one.  Once again, I'm starting to feel like Monk.  (Here's another plug:  great show, check it out).

Marcus called us at Alembic this morning to ask some technical questions, and I was the person he refers to above who could not give him the tech details. We had a plesant conversation, and he mentioned that he got a deal on a rack of gear, but that since he did not have any Alembics he did not need the DS5R; he was about to post on e-bay and was trying to gather as much info as possible to get ready for the questions he figured he would get.
I suggested this forum to him as a quick and sure way to sell it.  
Adam later called me after the item was listed on E-bay and pointed out that Marcus was also selling the Bass Pod Pro, and that it seemed likely that those came from the rack stolen from Frank a while back along with the now-recovered Understated Elegance.
If, as it seems, this stuff came from Frank's rack then I'll throw in my 2 cent gut feeling that Marcus bought the rack with no idea that it was stolen.

WOW! Now I really feel bad. Having been the victim, at one time, of having 76AC070 stolen from me (and later on recovered, thankfully) I know how violated one feels when it happens. The LAST thing that I want to do is possibly perpetuate a potential fraud perpetrated on someone. Which puts me in a ticklish sitiuation - now that I have already paid for the DS-5R. I suppose that I'll have to lurk about here until some additional information is reported. In any event, if anyone DOES determine that the DS-5R was pilfered - please inform me ASAP as I will be more than willing to see justice served, even if it costs me in the doing!

Hey Chris.  Marcuss seems like an honest guy.  Don't sweat it.  If it turns out to be stolen, it will probably end up being sold by him for the insurance company (or whatever settlement is determined) and he will then sell it to you or refund you your money.  He was not trying to hide anything on here or when he called Alembic, and he does have excellent eBay feedback.  Frank was probably paid for the rack stuff too, in his settlement.  So I cannot see anyone losing here, except for maybe the insurance company.  Ya, like they 'lose' money?!

talk to my girlfriend about insurance companies losing money...after driving for 14 years(and yes, she was very tired after all that time!) she got in the first accident she's ever had.  three days later she got a completely unrelated notice from Mutual of Enumclaw (Mutu-Hell of The Evil Claw) that her policy had been retroactively cancelled due to a bank error. Her ass remains out in the wind while the insurance comissioner investigates. But more to the  task at hand.....
 
and to clear the air before you bass-totin' villagers light all that tinder piled beneath my feet, I do believe this may be the unit they are looking for... And, at the same pawnshop I bought it from I did see: 1- the bass pod pro(and yes, i used the previous picture from another unit to sell it- both were/are mint and i am/are/be lazy), 2- the korg tuner(same serial #'s, looks like I am the father after all!), 3- an skb rack(4-space if I remember(?),NOT the one in my ebay listing- that's mine, stole it m'self!(joke, laugh here)). these items are now on police hold pending an investigation. thank me later...
 
after talking with the manager i believe that there are other items in their posession that were received from the same individual as everything stated above, with the exception of the power supply. it would seem that the power supply was pawned or sold by a different person(although much of what i believe i know was gleaned from that which was NOT said during our conversation, as he cannot legally divulge personal information about people to me as I am not the police last I checked).
 
So as for my intentions.....unfortunately the power supply has no serial # and i already spent the money from it's sale on a vet bill for my cat(the black one in the listing, quite ironically..he got tangled up in $262 worth of barbed wire the other day and has a shaved Franken-Kitty belly full of stitches right now). since the victim of the theft has apparently already made a claim with his insurance company i intend to do the only thing i think makes sense:wait. ethically speaking, what can i do? my listing this thing and doing the research and footwork should result in the recovery of about $2500 worth of gear for the insurance company...should i feel bad for them? perhaps they have some pull with Mutual of Enumclaw... should i expect a frickin' reward? do i ship it and just wash my hands of the whole thing? why do crackheads have to ruin it for the rest of us hard-working slobs?
 
i'm sure you'll all chime in, so let's take the mic out in the audience....

why do crackheads have to ruin it for the rest of us hard-working slobs?  You got that right Marcus.  Unfortunately, bad things do happen to good people.  I hope your girlfriend was not hurt in the accident.  The price of integrity is to eat the bad with the good that comes our way.  
 
Ethically speaking, it should be Chris's decision if he wants a refund, or if he wants to ride it out and maybe get the power supply in the end.  He made the purchase in good faith, and obviously PayPal'd you immediately.  Waiting for the confirmation of who's property the power supply is - Frank's, the insurance company's, or yours - seems reasonable.  
 
This is a public forum, so often matters that seem private do get discussed.  The only sparks I will let fly at the tinder under your feet are that I do not believe you could have already spent Chris' money, as PayPal does not instantly deposit into a seller's account (they make some of their money by holding the funds for a day or two - They do instantly take money from the buyer's account), from my understanding and experiences with PayPal, and I believe it is the seller's responsibility to take care of his or her customers when things go wrong.

FYI - I have taken some precautionary measures and am trying, in earnest, to sort through all of this with the Seller. I feel that this forum should not be the venue for my attempts. As such, I am conducting my affairs privately. I will, however, make a report when everything is settled. Of course, if anything of an urgent nature arises - Mica and Susan know how to find me! Thanks for everyones help to-date.

thanks for your input everyone, issue resolved. it's chris' baby now(today in the east a child is born....)
 and for the record: paypal does make money immediately available, depending on the source. in this case it was there as soon as chris bought the unit and i took it out and i spent it, as was my right and perogative(no offense taken, simply answering all issues raised). i believe the hold times are there when the funds are coming to paypal indirectly, like from another bank account or a credit card. my assumption is that chris had the coins in his paypal piggy and could therefore spend it directly. 'nuf said.....AND;
my girlfriend's insurance recapitulated and recanted their evil afformentioned crap. hoo-frickin'-ray, they eat some crow and we don't have to eat top ramen for the rest of our lives to cover their stupid greedy assets!
