Hmm. Unethical, to be sure (the seller does say Alembic style) but not outright fraud.  
If you want to see misleading auctions, do a search for Louis Vuitton handbags, as my wife and I did last night. Out of 400+ listings, at least half are for lists of wholesalers, not actual merchandise, which was not readily apparent in most cases, at least to her.
